《内蒙古自治区建设用地置换办法》已经2007年12月28日自治区人民政府第12次常务会议审议通过,现予发布,自2008年3月1日起施行。

第一条 为规范建设用地置换行为,优化土地利用结构,促进经济社会可持续发展,结合自治区实际,制定本办法。
第二条 本办法所称建设用地置换,是指依法取得的不宜利用的原有建设用地,在完成土地复垦后与经过土地利用总体规划规划为建设用地的农用地(以下简称农用地)或者其它建设用地进行置换的行为。
第三条 建设用地置换应当遵循自愿、合法、有偿的原则,切实维护土地权利人的合法权益。
第四条 旗县级以上人民政府国土资源行政主管部门负责建设用地置换的监督管理工作。
第五条 置换后的建设用地用途应当与原建设用地用途相同,并符合土地利用总体规划、城市总体规划、村庄和集镇规划。
第六条 建设用地与农用地置换的,置换后的建设用地面积不得超过置换前的建设用地面积;复垦的建设用地的质量等级低于被置换的农用地质量等级的,应当按照农用地质量等级系数折算为用于置换的农用地的数量;复垦后的建设用地的质量等级高于被置换的农用地质量等级的,与被置换的农用地实行相同数量置换。
第七条 建设用地置换涉及农民集体所有土地的,应当经该集体经济组织村民会议2/3以上成员同意,并经土地使用权人同意。
第八条 建设用地置换时,双方当事人应当协商一致,签订建设用地置换协议;协商不成的,申请置换方可以申请旗县以上人民政府国土资源行政主管部门组织协调,协调仍达不成一致意见的,不得置换。
第九条 建设用地置换协议应当包括下列主要内容:
(一)当事人的名称或者姓名和住所;
(二)置换土地的权属、位置、面积;
(三)置换土地的原用途和置换后的用途;
(四)土地差价、地上附着物的补偿价;
(五)拆迁安置途径与方式;
(六)同意权属变更的意见;
(七)履行期限和方式;
(八)违约责任;
(九)解决争议的方法。
建设用地置换涉及农用地的,还应当包括对农用地质量等级折算的意见。
第十条 申请建设用地置换的,申请置换方应当向旗县级人民政府国土资源行政主管部门提供下列材料:
(一)建设用地置换申请表;
(二)建设用地置换协议;
(三)土地利用现状图、勘测定界报告书和勘测定界图;
(四)取得建设用地的土地权利证书。
建设用地与农用地置换的,申请置换方还应当提供原有建设用地复垦后经法定验收机关验收后出具的验收意见,提供被置换农用地的土地权利证书。
建设用地置换涉及农民集体所有土地的,申请置换方还应当提供符合本办法第七条规定的证明材料。
第十一条 旗县级人民政府国土资源行政主管部门应当自收到申请材料之日起20日内,对拟置换的土地进行实地踏勘,并对其权属、地类、面积以及地上附着物权属、种类、数量等现状进行认真核实。符合本办法规定的,由旗县级人民政府国土资源行政主管部门受理并编制土地置换方案。
第十二条 旗县级人民政府国土资源行政主管部门应当将土地置换方案在申请置换地、被置换地的主要媒体上公告,公告期为15日。
第十三条 土地置换方案在公告期内有异议的,由旗县级人民政府国土资源行政主管部门进行处理,处理后仍有异议的,不得置换。
第十四条 土地置换方案在公告期内无异议的,按照下列规定逐级报批:
(一)国有建设用地之间、农民集体所有建设用地之间的置换,由盟行政公署、设区的市人民政府、旗县级人民政府审批;
(二)建设用地与农用地的置换,由有农用地转用批准权的人民政府审批;
(三)国有土地与农民集体所有土地的置换,由自治区人民政府审批,并依法办理征地审批手续。
第十五条 农用地转用批准后,因城市规划调整等原因未实施供地,现状仍为农用地的土地,确需与其它农用地置换的,由盟行政公署、设区的市人民政府、旗县级人民政府国土资源行政主管部门编制征收土地方案和土地置换方案,报自治区人民政府批准后实施。
按照前款规定实施建设用地置换的,原农用地转用批准的补充耕地方案继续有效。
第十六条 国土资源行政主管部门收到申请材料后,需要两级以上人民政府报批的,负责审核的机关应当在20日内提出审核意见,并转报负责审批的机关;负责审批的机关应当在收到材料后20日内做出批准或者不予批准的决定。20日内不能做出决定的,经本机关负责人批准,可以延长10日。
第十七条 建设用地置换双方应当自建设用地置换批准之日起1年内,按照建设用地置换协议置换完毕,并在置换完毕之日起30日内,持土地权利证书及相关材料向原土地登记机关申请办理土地变更登记手续。
逾期未置换或者未置换完毕的,批准文件自动失效。
第十八条 建设用地与农用地置换,按照本办法第十四条规定审批后,不再另行办理农用地转用审批;置换的农用地不占用农用地转用年度计划指标。
第十九条 建设用地置换涉及林地、草原的,应当按照国家、自治区有关法律、法规的规定,办理相关审批手续。
第二十条 建设用地置换的,申请置换方应当缴纳法律、法规规定的相关税费。
第二十一条 原建设用地复垦为耕地与农用地中的耕地置换后,超出部分的复垦耕地面积可以纳入补充耕地的范围。
第二十二条 旗县级人民政府国土资源行政主管部门应当建立建设用地置换管理台账,记载建设用地置换前和置换后的位置、面积、地类、实施情况等内容,对置换土地进行专项统计、按月逐级上报,并及时对土地利用现状图和土地利用数据库进行变更,纳入当年变更流量。
第二十三条 未经批准或者采取欺骗手段骗取批准实施建设用地置换的,按照《中华人民共和国土地管理法》第七十六条的规定处理。
第二十四条 违反本办法规定批准建设用地置换、超越权限批准建设用地置换或者对不符合置换条件的建设用地批准置换的,批准文件无效,对直接负责的主管人员和其他直接责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任。
非法批准置换建设用地,对当事人造成损失的,应当依法承担赔偿责任。
第二十五条 建设用地置换中涉及农村宅基地置换的,不适用本办法。
第二十六条 本办法自2008年3月1日起施行。

delegations of the two Governments, agreed to declare as follows:
