民政部关于台湾同胞回大陆办理丧葬问题的通知

各省、自治区、直辖市民政厅(局),各计划单列市(区)民政局:
自台湾当局允许一般民众回大陆探亲以来,回大陆探亲的台胞日渐增多。他们中间,有的要求祭扫和修复祖墓,有的提出购买墓地,有的询问回大陆安葬骨灰或遗体等丧葬方面的政策。民政部、国务院侨务办公室1984年5月28 日联合下发的《关于华侨去世后回国安葬问题的通知》[民
(1984)民20号)]和1984年7月23日联合下发的《关于华侨修复祖墓问题的通知》[〈84〉侨政会字第042号 ]中,已经对台胞回大陆安葬骨灰和修复祖墓的问题作过规定,这些规定仍然有效。对各地工作中遇到的新问题,经征得中央对台办同意,特作如下通知:
一、台胞回大陆探亲、旅游期间要求祭扫祖墓,凡能查找到的,一般应允许祭扫;已经平毁的,可视具体情况加以解释。对祭扫和修复祖墓要加强管理,不得搞封建迷信活动,不得恢复和建立宗族墓地,不得占用耕地或在国家规定保护的范围内修坟造墓,要注意防止坟山以及由此引?

二、台胞去世后,其亲属要求回大陆安葬,一般只允许安葬骨灰。要求将遗体运回大陆安葬的,须由其亲属报请其原籍所在地的省、自治区、直辖市民政部门依当地有关规定从严审批,批准后还须经海关卫生检疫合格。安葬地点由民政部门负责安排。当地有公墓的,安葬在公墓内;没
有公墓的,可在当地政府指定的荒山荒地或不宜耕种的瘠地埋葬。
三、回大陆探亲、旅游期间去世的台胞,如死者生前或其亲属要求在大陆安葬,应遵守安葬地人民政府有关殡葬管理的规定。如其亲属要求将遗体或骨灰运出大陆以外安葬,一般应予同意,殡葬管理部门要提供方便,做到热情服务,收费合理。对患急性传染病去世或高度腐败的遗体,
须就地火化或深埋。
四、为满足台胞落叶归根的愿望,台胞较多的地方可根据需要,选择荒山荒地兴办为台胞服务的骨灰公墓。按国家有关规定批准的公墓中,允许向台胞出售或预售骨灰墓穴。收费标准比照港澳同胞收取,确有困难的,可酌情予以优待。
五、台胞在大陆的丧葬事宜,由民政部门统一管理,遇有重大疑难问题,应与对台部门协商,共同研究确定。
附一:卫生部实施《中华人民共和国国境口岸卫生监督办法》的若干规定(摘录)

第九条 尸体、棺柩的有关规定。
一、移运前应当出示死亡诊断证明书;
二、尸体必须进行防腐处理;
三、棺柩封闭严格,无腐败液体渗出,无臭味散出;
四、经上述检查后认为满意者,签发进出境尸体棺柩移运许可证后,方准移运。
附二:海关总署关于对尸体、棺柩和骨灰进出境管理问题的通知

关于对尸体、棺枢和骨灰进出境的管理问题,原有一些规定,有的已经不适应现在的情况。为此,现根据卫生部(83)卫防字第5 号通知印发的《实施〈中华人民共和国国境口岸卫生监督办法〉的若干规定》第九条的规定,重新规定如下:对进出境的尸体、棺柩,海关凭卫生检疫机关签
发的进出境尸体棺柩移运许可证放行。旅客携带和个人邮寄骨灰进出口,如无异常情况,可迳予放行。
本通知执行后,原外贸部海关总署(58)关行殷字第986号指示附件(一)关于对灵柩、骨灰管理的规定即予废止。

PART I PRELIMINARY

Ordinance may be cited as the Trade Descriptions Ordinance.

In this Ordinance, unless the context otherwise requires--

a trade mark relating to goods registered in Hong Kong under the
Trade

registered, or in respect of which an application for

made, in a British territory or a Convention country; and
capable of registration in Hong Kong under the Trade Marks

(a) For the purposes of this Ordinance, goods shall be deemed to

manufactured in the country in which they last underwent a

Where an order under this section is in force with respect to goods

description, any person who, in the course of any trade or
business,

order commits an offence.
An order under this section may make different provision for

umstances and may, in the case of goods supplied in
circumstances
e the information or instruction required by the order would
not be
eyed until after delivery, required the whole or part thereof
to be
displayed near the goods.

PART II FALSE TRADE DESCRIPTIONS OR REPRESENTATIONS AND
FORGED TRADE MARKS

青岛市医疗卫生机构管理暂行规定

第一章 总则
第一条 为加强医疗机构的管理,维护医疗服务秩序,保障公民身体健康,根据国家有关法律、法规,结合本市实际情况,特制定本规定。
第二条 凡在本市范围内的下列医疗机构,均应遵守本规定:
(一)市、县(市)、区卫生行政部门所属的全民、集体所有制医疗机构;
(二)国家机关、企业、事业单位所属的医院、门诊部、保健站(卫生室);
(三)中央和省属驻青医院、疗养院;
(四)驻青部队向社会开放的医疗机构;
(五)由社会团体、民主党派、大专院校、国家机关、部队、企业事业单位、集体组织或个人自筹资金举办的各类医院、疗养院、门诊部、诊所等社会医疗机构;
(六)各类医院依靠本身的技术人员、资金、设备所举办, 并进行统一领导和管理的分院;
(七)两个以上医疗机构按各方签订的协议开展技术协作的医疗协作联合体;
(八)个体开业行医和联合诊所。
第三条 市、县(市)、区卫生行政部门是本市各级各类医疗机构管理的主管部门。
卫生行政部门的医政人员和受卫生行政部门委托的卫生监督人员有权持市卫生行政部门制发的《医疗工作监督检查证》对医疗机构的各项活动进行监督检查。
第四条 各级各类医疗机构及其从业人员必须遵守国家的法律、法规,遵守医德规范,提高医疗服务质量,接受主管部门的管理和群众的监督。
第二章 医疗机构管理
第五条 医疗机构的设立应统一规划,合理布局。各级各类医疗机构必须经卫生行政部门审批、登记,核发《执业许可证》后方可开业。其他任何部门和单位均无权审批医疗机构。
第六条 各级各类医疗机构必须具备规定的资格和条件,有与执业范围相适应的专职卫生技术人员,有与工作相适应的医疗业务用房和病床,有供诊断、治疗、抢救等医疗活动的器械设备和药品等。
第七条 申请开办医疗机构的单位和个人,必须向卫生行政部门提交书面申请,并提供卫生技术人员名单及资格证明文件、业务用房产权证书或租赁合同以及医疗机构的组织章程及管理制度等。
申请应写明机构名称、开业地点、负责人姓名、人员编制、床位数、业务范围、资金来源及数量、主要医疗设备及房屋情况等。
第八条 开办医院(含康复医院,下同)、疗养院,在市南、市北、台东、四方、沧口五区的,由市卫生行政部门审批。在其他地区的,由所在地县(市)、区卫生行政部门审批。
第九条 开办门诊部、诊所和个体开业行医及联合诊所的,由所在地县(市)、区卫生行政部门审批。
第十条 国家机关、企业、事业单位设立保健站(卫生室),在市南、市北、台东、四方、沧口五区的,由市卫生行政部门审批;在其他地区的,由所在地县(市)区卫生行政部门审批。
第十一条 中央、省属驻青医院、疗养院,驻青部队的医院、疗养院、门诊部,国家机关,企业事业单位所属医院在保质保量完成自身医疗保健任务的前提下,经本单位上级领导部门同意,由市卫生行政部门审批后,可以向社会开放。
机关、企业、事业单位的保健站(卫生院),不得向社会开放。
第十二条 各级医院开设分院的,应经医院主管部门同意,由分院所在地县(市)、区卫生行政部门审批,并报市卫生行政部门备案。
医院开设分院必须依靠单位的人员、资金、设备,并对分院医疗服务质量负责。医院未投入人员、资金、设备的医疗机构不得以其分院的名义开展医疗活动。
第十三条 建立医疗协作联合体的应经协作各方的上级领导部门同意。在市南、市北、台东、四方、沧口五区的由联合体所在区卫生行政部门初审,报市卫生行政部门审批;在其他地区的由联合体所在地县(市)、区卫生部门审批。
医疗联合体各方应签订医疗协作协议。协议应对各方协作的宗旨、内容、方式、收入分配以及各自的权利义务等作出明确规定。
任何个人或科室不得擅自和医疗机构签订医疗协作协议书。
第十四条 医疗机构的名称,须经卫生行政部门统一审核、批准。
医疗机构的名称,不得以大冠小,不得任意冠以省、市中心、分院、专家门诊等字样。医疗协作联合体应在主体医院和协作医院名称后冠以联合体字样;社会医疗机构应冠以主办单位名称或“民办”字样;个体开业行医和联合诊所应冠以开业者姓名。
第十五条 医疗机构的牌匾和印章必须严格按照卫生行政部门批准的名称刻,并报批准部门备案。
第十六条 医疗机构需改变机构名称、执业地点、业务范围、服务项目时,应向审批部门办理变更登记手续。停业时应办理停业手续。
第十七条 医疗机构张贴、刊登、播放广告,应事先报卫生行政部门核准。广告内容只限于宣传医疗机构的功能、设备、诊疗科目和病种,不得宣传诊疗效果,严禁弄虚作假。
第三章 医疗活动管理
第十八条 各类医疗机构必须按批准的业务范围行医,不得随意改变科目或扩大业务范围。专科医疗机构,只能接待专科病人。
第十九条 各类医疗机构应承担卫生防疫。传染病防治、妇幼保健、计划生育和卫生宣传等义务。
第二十条 各类医疗机构及其医务人员必须严格执行医疗护理技术操作规程、用药规定和医疗规章制度。
第二十一条 医疗机构必须加强病历、处方等各种医疗文书和票据、收支账、药品购销账等原始凭证、账目的管理。
有关表册、处方、单据等由市卫生行政部门会同有关部门统一制订。处方要保存三年备查;住院病历须长期保存。
第二十二条 医疗机构对急重病人实行首诊首科负责制,不和推诿病人。必须转往其他医疗机构治疗的,应于所转单位联系,经同意后及时办理转诊。不得收取“转诊费”。
第二十三条 医疗机构的医疗收费项目和收费标准须经市卫生行政部门审核,市物价部门批准。医疗机构要按照《山东省收费许可证管理暂行办法》的规定,到物价部门办理《收费许可证》。
医疗收费要使用财政部门统一监制的行政事业性收费专用票据和卫生行政部门认可的门诊、住院收据和现金收讫印章,未经卫生行政部门认可的收据和现金收讫印章不得使用。
第二十四条 医疗机构要严格执行入院标准和医疗检查标准。不得以“挂床”形式收取患者住院费,不得因贪图经济收入而延长已达出院标准患者的住院时间,来禁以经济提成等不正当办法拢络患者住院。医疗检查不得随意扩大项目,严禁收取医疗检查“介绍费”。
第二十五条 医疗机构发生医疗差错或事故时,要及时如实地向当地卫生行政部门报告,由卫生行政部门按《医疗事故处理办法》等有关规定处理。
第二十六条 县级以上(含县级)医疗卫生机构的医务人员在完成本职工作任务和不妨碍本单位工作的前提下,经本单位同意,由卫生行政部门批准,可在本单位的统一组织下开展业余服务和在院外兼职进行医疗活动,并按规定缴纳管理费和提取个人分成。
第四章 罚则
第二十七条 对违反本规定的单位和个人,卫生行政部门可视其情节轻重,予以警告、罚款、停业整顿、没收非法所得、取消行医资格、吊销《执业许可证》的处罚。处罚可以单处也可以并处。
第二十八条 对未经卫生行政部门审批、核发《执业许可证》而进行非法行医活动的,责令其立即停业,没收全部非法所得,并处以五百元至二千元的罚款。对非法行医造成严重后果,构成犯罪的,由司法机关依法追究刑事责任。
第二十九条 对医疗机构的名称、牌匾、印章与审批、登记的内容不相符的,予以停业整顿,并处以二百元至五百元的罚款。
第三十条 对未经卫生行政部门核准,乱贴、乱登广告或广告内容弄虚作假、夸大医疗效果的,处以五十元至二百元的罚款。
第三十一条 对擅自扩大业务范围、改变科目的,责令停业整顿,并处以五百元至一千元的罚款;情节严重的吊销《执业许可证》。
第三十二条 对未经批准随意扩大收费项目、提高收费标准,或私自收取“介绍费”、“转诊费”的,予以警告、没收非法所得,并处以二百元至一千元的罚款。
第三十三条 对使用未经卫生行政部门认可的收据和收讫印章的,予以警告,并处以五十元至二百元的罚款。
第三十四条 对未经同意和批准擅自进行业余行医或兼职行医的,予以警告,并处以五十元至五百元的罚款;情节严重的,取消行医资格。
第三十五条 罚款应统一使用财政部门制发的罚款收据。罚款一律上缴同级财政。
第三十六条 医政人员和卫生监督人员玩忽职守、滥用职权、徇私舞弊的,由其主管机关、监察部门给予经济处罚和行政处分;构成犯罪的依法追究刑事责任。
第五章 附则
第三十七条 本规定由市卫生局负责解释。
第三十八条 本规定自发布之日起施行。
